This Policy explains your right to withdraw from an order placed with Oceanna The Label Corp (“OTLC”, “we”, “us”) and how to exercise it.
1.1 Definitions
Goods means the products ordered by you through our website (the Site).
Order means a purchase of Goods placed by you on the Site.
Withdrawal Period means 14 calendar days, calculated as set out in Section 1.3.
Withdrawal Notice means a clear statement communicating your decision to withdraw from an Order, given via the Withdrawal Button described in Section 1.2 or by any other clear statement to us.
1.2 How to withdraw; the Withdrawal Button
If you are a consumer located in the European Union, you may withdraw from your Order, without giving any reason, within the Withdrawal Period. You may exercise this right using the electronic withdrawal function available on the Site (the “Withdrawal Button”) at https://oceannathelabel.com/pages/eu-withdrawal-form, or by any other unambiguous written statement to info@oceannathelabel.com
The Withdrawal Button will ask you for your name, Order number and contact details, and will ask you to confirm your decision to withdraw before submitting it. On submission, you will receive an automatic confirmation of receipt by email.
1.3 When the Withdrawal Period runs
The Withdrawal Period expires 14 days after the day on which you, or a third party you nominate, take physical possession of the Goods (or, for an Order comprising multiple Goods delivered separately, 14 days after receipt of the last item). You may also submit a Withdrawal Notice at any time between placing your Order and receiving the Goods.
Placing an Order does not obligate us to delay dispatch. We may ship your Order at any time after it is placed, including before the Withdrawal Period has run its course.
1.4 Effect of withdrawal; returning the Goods
If you submit a Withdrawal Notice after the Goods have been dispatched or delivered, you must send the Goods back to us without undue delay and in any event within 14 days of the day you communicate your Withdrawal Notice. This obligation applies whether the Goods have already been delivered to you or are still in transit at the time of your Withdrawal Notice; withdrawing from an Order after dispatch does not convert the transaction into something other than a withdrawal, and the terms of this Section apply in either case.
1.5 Cost of returning the Goods
You will bear the direct cost of returning the Goods to us. Estimated return shipping costs are 45 euros with DHL tracked shipping.
1.6 Refunds
If you validly withdraw, we will reimburse all payments received from you for the relevant Order, including the standard delivery charge, without undue delay and in any event within 14 days of the day we are informed of your decision to withdraw. We may withhold reimbursement until we have received the Goods back, or you have supplied evidence of having sent them back, whichever is earlier.
If you chose a delivery method other than the least expensive standard delivery we offer, we will not refund the supplementary cost of that upgraded delivery. We do not refund customs duties or import charges incurred on the original shipment or on the return.
We will use the same means of payment you used for the original Order, unless you expressly agree otherwise, and you will not incur any fee for the reimbursement itself.
1.7 Condition of returned Goods
You are only liable for any diminished value of the Goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
1.8 Exceptions to the right of withdrawal
The right of withdrawal does not apply to, among other things:
- Goods made to your specifications or clearly personalised;
- Sealed Goods which are not suitable for return for health protection or hygiene reasons, where unsealed by you after delivery;
- Goods which, after delivery, are inseparably mixed with other items.
1.9 UK customers
The withdrawal function described above responds to an EU-specific requirement and does not itself apply to consumers located in the United Kingdom. UK consumers have a separate, broadly equivalent right to cancel an Order within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015. The cost allocation and refund terms in Sections 1.5–1.6 above apply equally to UK customers exercising this right. UK customers may exercise it by emailing info@oceannathelabel.com; use of the Withdrawal Button is optional for UK customers, not mandatory.
